FMLA Entitlement Calculator

Determine how many hours of FMLA leave you have remaining under the Family and Medical Leave Act. Use this when planning a medical event, caring for a family member, or advising employees on leave rights.

About this calculator

The Family and Medical Leave Act entitles eligible employees to up to 12 weeks (480 hours) of unpaid, job-protected leave per year. Eligibility requires three conditions to all be true: the employee must have worked for their employer for at least 12 months, worked at least 1,250 hours during the last 12 months, and work at a location where the employer has 50 or more employees within 75 miles. The formula is: Remaining FMLA = (employmentMonths ≥ 12 AND hoursWorkedLast12Months ≥ 1,250 AND companySize ≥ 50) ? max(0, 480 − fmlaUsedCurrentYear) : 0. If any eligibility condition is not met, the result is zero. Hours already used in the current leave year are subtracted from the 480-hour entitlement.

How to use

An employee has worked at a 200-person company for 18 months, logged 1,400 hours in the past year, and has already used 120 hours of FMLA this leave year. Step 1 — Check eligibility: 18 months ≥ 12 ✓, 1,400 hours ≥ 1,250 ✓, company has 50+ employees ✓. Step 2 — Calculate remaining: max(0, 480 − 120) = 360 hours remaining. That equals 9 weeks of FMLA leave still available this leave year.

Frequently asked questions

Who qualifies for FMLA leave and what are the eligibility requirements?

To qualify for FMLA, an employee must meet three criteria simultaneously: they must have been employed by the same employer for at least 12 months (not necessarily consecutive), worked at least 1,250 hours during the 12 months immediately preceding the leave, and work at a location where the employer has 50 or more employees within a 75-mile radius. Part-time employees can qualify if they meet the hours threshold. If any single criterion is not met, the employee has no FMLA entitlement regardless of the reason for leave.

How many hours or weeks of FMLA leave am I entitled to take per year?

Eligible employees are entitled to up to 12 workweeks — or 480 hours — of FMLA leave in a 12-month period for most qualifying reasons, including serious health conditions, caring for a family member, or the birth or adoption of a child. A separate entitlement of up to 26 workweeks exists in a single 12-month period to care for a covered servicemember with a serious illness or injury. This calculator focuses on the standard 480-hour (12-week) entitlement.

Can FMLA leave be taken intermittently and how does that affect the calculation?

Yes, FMLA leave can be taken intermittently in separate blocks of time or by reducing a normal weekly or daily work schedule, when medically necessary. Intermittent leave is tracked in hours, not full weeks, which is why this calculator works in hours rather than weeks. Each hour taken counts against the 480-hour annual entitlement. Employers may require employees to use accrued paid leave (vacation, sick time) concurrently with FMLA, but this does not extend the total entitlement beyond 480 hours.
